If these Terms of Service are offered in any language other than English it shall be for information purposes only and, in case of conflict between the English-language version and any translation thereof, the English-language version will prevail.

SUMMARY TERMS OF SERVICE  

The following summary provides an overview for your convenience of LiveStarX's most important terms that govern your use of LiveStarX (www.LiveStarX.com, “the Website”). This is a non-binding summary of the applicable Terms of Service of the Website, that covers selected aspects of the same in a simplified manner. It is not a substitute for our binding Terms of Service, which include our policies and guidelines (“our Terms”). In all cases, our Terms prevail.

NOTE : Any capitalized terms not defined herein shall bear the meaning attributed to them in the Terms.

1. Our Terms contain the terms and conditions governing your use of, and access to, LiveStarX,  its Content, functionalities, and services, and your contractual relationship with us, ER Global Trade Corporation IBC, Room 303, House of Francis, Ile Du Port, Mahe, the Republic of Seychelles, as the operator of LiveStarX (“we”, “us”). They address the following points, among others:

a. Acceptance: By accessing, using, or visiting the Website, and/or any of its Content, functionalities, and services, you communicate your agreement to our Terms.

b. Termination: You may terminate our Terms at any time by deleting your account and refraining from further use of our services.

c. Age and Restrictions: You affirm that you are at least eighteen (18) years of age and the age of majority in the jurisdiction you are accessing the Website from. You also represent that the jurisdiction from which you access the Website does not prohibit the receiving or viewing of sexually explicit Content.

d. Changes: We reserve the right to withdraw or amend the Website, and any service or material we provide on the Website in our sole discretion and without notice. We may amend our Terms. If we do, we will give you reasonable advance notice in a transparent manner. Unless otherwise specified by us, you will be deemed to have agreed to any such changes unless you notify us, in writing and prior to the effective date of the changes, that you do not agree. If you do not agree to the changes, you may no longer use the Website after the proposed changes come into effect. In this case, either you or we may terminate these Terms with immediate effect.

e. Third party content: When using the Website, you may be exposed to Content from a variety of sources for which we are not responsible. We also assume no responsibility for third party websites that may be accessed via links found, placed, or otherwise displayed on the Website.

f. Communication and Single Point of Contact: By registering as a User on this Website (and by using the same), you expressly and specifically consent to receiving electronic communications from us relating to your account. LiveStarX provides a single point of contact in accordance with the Digital Services Act (DSA), which you can use for communications on topics specific to the DSA: dsa@livestarx.com, or via our mailing address: ER Global Trade Corporation IBC, Room 303, House of Francis, Ile Du Port, Mahe, the Republic of Seychelles.

g. License: We grant you a conditional, revocable, non-sublicensable, non-transferable, non-exclusive, limited license to access and use our Website solely for your personal use, conditioned upon your compliance with our Terms. You must view the Website in whole and as presented by its host.

h. Rules for Content and Uploaders: The Website is for adult-oriented Content. Some Content can only be uploaded after a verification process or after joining a partner program.

You represent and warrant that, with respect to all Content you may upload on this Website:

- The Content must not violate any applicable laws or infringe the rights of others. 

- You have obtained the consent and release for every individual appearing in your Content.

- You have verified that each individual appearing in your Content was at least eighteen (18) years of age at the time of production and you have collected, examined and maintained sufficient record of this age verification.

- No individual appearing in your Content has been convicted of any crimes relating to sexual assault, sexual exploitation of a minor, trafficking, and other related criminal offences.

- The Content complies with our Terms. The Content does not contain or comprise of, for example: child sexual abuse material (CSAM), non-consensual content (NCC), revenge porn, blackmail, intimidation, fraudulent content, misleading content, and gambling. 

In addition, there are further requirements in our Terms, including special terms for models and content partners, that must be accepted by joining our model or content partner program.

i. Online Safety Act (Australia): This Website prohibits uploading content that includes or contains illicit materials, specifically those related to child sexual exploitation, extreme crime, violence, terrorism, and certain drug-related materials. Content Partners, Models, and Verified Uploaders must not upload such material, as we have the right to immediately remove and report it. 

j. Prohibited Use: All Content uploaded to, and use of, the Website must be legal and follow our Terms and must, in particular, respect the section “Prohibited Uses and Reporting” of our Terms. 

k. Reporting: Users are urged to report Content they suspect of being illegal or in violation of our Terms.

l. Monitoring and Enforcement; Termination: We have the right to enforce our Terms through appropriate measures we deem appropriate, which may include: 

- Written warnings

- Restriction of visibility or accessibility of Content, your access to our services, monetization, earnings, and payouts

- Reporting to law enforcement

You may lodge a complaint within 6 months of being notified of our decision. You may not misuse this procedure. If you believe that any Content violates your copyright, you may also refer to our Copyright Policy for instructions on sending us a notice of copyright infringement.

m. Information about You and Your Visits: All information we collect on the Website is subject to our Privacy Notice. The Cookie Banner can be utilized to customize your cookie preferences. You can access the Cookie Banner anytime by clicking on the 'Manage cookies' option that is located at the footer of the Website.

n. Collection and Use of Your Usage Information by Advertisers and Others: Third parties that place advertising on this Website may have the ability to use cookies and/or web beacons to collect information, including information about your usage of this Website. We do not control the processes that advertisers may use to collect such information.

o. Linking to this Website and Social Media Features: You may link to this Website and use certain social media features, but always subject to the Terms.

p. Collection and Permitted Disclosure of Personal Information: This Website will not disclose any personally identifiable information we collect or obtain, except in the cases expressly provided in our Terms.

q. Indemnification: To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless this Website, us as its operator, and others as detailed in the Terms.

r. Disclaimer: You use the Website at your sole risk. We provide the Website “as is” and “as available”. Further details are provided in our Terms.

s. Limitation of Liability: Our liability is limited, as provided in our Terms.

t. Limitation on Time to File Claims: Any cause of action or claim must be commenced within a maximum of one (1) year after the cause.

u. Arbitration and Waiver of Certain Rights (US): Users located in the United States of America will resolve any disputes between us through binding and final arbitration instead of through court proceedings, as provided in more detail in our Terms.

v. Arbitration and Waiver of Certain Rights (EU): If you or your place of establishment is in the European Union, you may have the right to select a Dispute Settlement Body to assist in resolving any disputes with us. We are neither willing nor obligated to participate in dispute resolution proceedings with consumers before a consumer arbitration board under the EU Directive on Consumer ADR.

w. Law and Jurisdiction: Our Terms, your use of this Website, and the relationship between you and us shall be governed by the laws of the Republic of Seychelles. The sole and exclusive jurisdiction and venue for any action or proceeding arising out of or related to our Terms shall be in a competent court located in the Republic of Seychelles.

x. Termination: We may terminate our Terms for any or no reason at any time by notifying you through a notice on this Website, by email, or by any other method of communication.

2. Compliance: This section provides further information as to what sort of Content is prohibited on the Website. It also provides useful links to our Community Guidelines, as well as to other explanatory and useful information that you have to be aware of when using the Website. 

3. Anonymous Content Removal Request: This is the form under which you can anonymously report to us any Content that you may suspect is in violation of our CSAM Policy. Additionally, it provides the link to the general Content Removal Request, as well as links to selected policies and guidelines to assist you with the completion of your request. 

4. Recommender System Guidelines: This policy outlines how we tailor recommendations to Users, prioritizing their privacy and safety, as well as compliance with applicable laws.

5. Trust and Safety: This section includes the applicable policies and guidelines that all Users should be complying with, including, but not limited to:

a. The LiveStarX Community:

-View Fraud: This section outlines our stance on fraudulent views, emphasizing that buying or faking views violates our Terms. It also acts as a warning to Users not to engage or participate in services that offer fake view boosts which could result in severe consequences, including account termination and permanent bans, as well as demonetization upon first occurrence and permanent banishment with forfeited earnings upon a second occurrence. 

-Trust and Safety Initiatives: This section provides a list of the measures and initiatives we take to prevent and respond to illegal Content on the Website and to ensure user safety.

-Core Values: This section provides a comprehensive list of our core values, as well as guidelines on “dos” and “don’ts” when using the Website. 

b. Policies and Related Guidelines: The below policies and guidelines illustrate our stance against several prohibited actions, that all Users should abide by when using the Website. Failure to comply with the below policies and guidelines might lead to adverse consequences including, inter alia, termination of your account.

c. Reporting Abuse and Violations:

-Report Harmful Content: Provides information and guidance on how you can report the following violative Content to us:

-videos, photos, or GIFs; or

-comments. 

-LiveStarX Trusted Flagger Program: This section provides information on the trusted flagger program developed by LiveStarX to provide a robust and efficient way for non-governmental organizations (NGOs) and statutory offices to report to us any Content that is in potential violation of applicable law and/or our Terms. It is also informative as to how we will handle such reports, as well as how to join the program (if you are eligible).

Acceptance of the Terms of Service By accessing, using or visiting www.livestarx.com (“we”, “us”, “our”, or this “Website”), any of its Content, functionalities and services, you signify your agreement to these Terms of Service including policies and related guidelines (for instance, Child Sexual Abuse Material Policy, and Non-Consensual Content Policy) (collectively the “Terms” or “Terms of Service”), and our Privacy Notice and incorporated herein by reference.

You may terminate these Terms of Service at any time by deleting your account and refraining from further use of our services.

These Terms of Service apply to all users, including Content Partners, Models, and Verified Uploaders who may also be contributors of Content, of this Website (collectively “you”, “User” or “Users” as the context requires), whether accessed via computer, mobile device, or other technology, manner, or means.

“Content” includes the text, software, scripts, graphics, photos, sounds, music, videos, audiovisual combinations, interactive features, textual content, and other materials you may view, upload, publish, submit, make available, display, communicate or post on this Website.

“Content Partners” means Users of this Website who have joined our Content Partner Program.

“Models” means Users of this Website who have joined our Model Partner Program and are subject to the present Terms of Service.

“Verified Uploaders” means Users of this Website who have a validly identified account.

If you do not agree to any of these Terms of Service or our Privacy Notice, please do not access or use this Website.

You consent to entering these Terms of Service electronically, and to storage of records related to these Terms of Service in electronic form.

Ability to Accept Terms of Service You affirm that you are at least 18 years of age and the age of majority in the jurisdiction you are accessing this Website from and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. If you are under 18 and the applicable age of majority, please do not use this Website. You also represent that the jurisdiction from which you access this Website does not prohibit the receiving or viewing of sexually explicit Content. For any removal orders pursuant to Regulation (EU) 2021/784 (the “Terrorist Content Online Regulation” or “TCO”), designated competent EU authorities can complete our removal form. After submission of this form, you will receive further instructions by e-mail, which you may respond to with a removal order. For such removal orders, please use the template provided in Annex I of the TCO and conduct all communication in either English.

Accessing this Website and Account Security We reserve the right to withdraw or amend this Website, and any service or material we provide on this Website, in our sole discretion without notice. We will not be liable if for any reason all or any part of this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts of this Website, or the entire Website, to Users, including registered Users.

Rules Applicable to All Content and Uploaders on this Website To upload Content to this Website, you must be either a Verified Uploader, a Content Partner, or a Model, save and except if such Content is limited to comments, a cover picture and/or an avatar. If the information you provide for the creation of your account is not true and correct, you face the immediate termination of your account; where applicable, the immediate suspension of any and all pending payments from us to you; and we may, in our sole discretion, withhold payment of any owed amounts indefinitely, and you may be subject to legal sanctions.

You represent and warrant that with respect to all Content you will upload on this Website:

1. the Content does not contravene to any applicable laws and does not subject this Website to any claims, demands, lawsuits, regulatory actions or any actual, potential or risk of liability, or any threats thereof;

2. you own the rights to use the Content on this Website and that the Content does not infringe on the rights (including intellectual property rights) of a third party and, that you have obtained the consent and release for every individual appearing in your Content, including the right for you to use and upload the Content on this Website;

3. for every individual appearing in your Content you have carefully ascertained and examined a valid governmental photo identification demonstrating that they are at least 18 years of age on the day they are photographed, filmed or otherwise appearing in such Content (this applies to all individuals, whether identifiable or not, or whether nude or not);

4. with respect to the Content, you, or the producer of the Content, have collected and maintained the records required under 18 U.S.C. § 2257 et. seq., as modified from time to time in compliance with the rules and regulations set forth in 28 C.F.R. § 75 et. seq., as modified from time to time, and any other applicable records keeping or age verification laws;

5. that Content Partner affirms that no individual appearing in the Content has been convicted of crimes relating to sexual assault, sexual exploitation of a minor, trafficking, and other related criminal offences;

6. the Content may be used for training purposes;

7. the Content is not a duplicate of another piece of Content uploaded by you or anyone else;

8. the Content complies with this Website’s Terms of Service and our Privacy Notice.

Failure to comply with these Terms of Service or any related contracts you will enter into with us, or should we determine that any of the statements above is untrue, or not complied with, we may, in our sole discretion, refuse to include the Content or any part thereof or any references to such Content on this Website, remove the Content in question from this Website, forfeit all accrued or pending earnings, cancel all current or pending payouts, terminate your account and take any measures necessary to minimize or eliminate any liability.

Online Safety Act - Rules Applicable to Australian Users For the purposes of this section:

- “Class 1A Material” shall mean any material, by any medium, that depicts, or otherwise contains child sexual exploitation/child sexual abuse, extreme crime and/or violence, or material that is in support of terror and/or acts of terror.

- “Class 1B Material” shall mean any material that depicts or otherwise contains crime and/or violence (but not extreme drug or violence), or drug-related material.

Class 1A Material and Class 1B Material may hereinafter collectively be referred to as “Illicit Material”.

Per the provisions of the Online Safety Act (2021) (the “OSA”) Content Partners, Models, and Verified Uploaders hereby must ensure and subsequently warrants that:

- The Content uploaded or attempted to be uploaded to this Website is in adherence to our Terms described herein.

- Any audiovisual Content uploaded or attempted to be uploaded to this Website does not contain Illicit Material.

- Content Partners, Models, and Verified Uploaders reserves the right to and shall take any action it deems necessary in order to limit, prevent, remove, or otherwise moderate any Content which infringes the provisions of this section and/or any other, applicable terms. Content Partners, Models, and Verified Uploaders shall also ensure, to the extent possible, that you comply with the provisions of this section.

- We have a zero-tolerance policy towards the solicitation, access, generation, distribution, or storage of any Content that involves the depiction of children or features Class 1A Material in any capacity. All child sexual exploitation/abuse material that we identify or are made aware of will result in the immediate removal of the Content in question as well as the immediate removal of its uploader from this Website. Without prejudice to all other rights reserved for action against the above (including account suspension, removal of infringing content etc.), we report all cases of apparent child sexual exploitation/abuse material to the National Center for Missing and Exploited Children.

Additional Information Applicable to All Users In conjunction with the provisions of these Terms of Service, the Non-Consensual Content policy, the Child Sexual Abuse Material policy, and our Privacy Notice, the guidelines found here are also in effect. You are solely responsible for familiarizing yourself with the latest version of these guidelines, as they are updated from time to time.

Obligation to comply with Records Keeping Requirements under 18 U.S.C. §2257. You certify that the Content you upload to this Website has been produced and records are being kept in accordance with 18 U.S.C. § 2257 et. seq., as modified from time to time, with the rules and regulations set forth in 28 C.F.R. § 75 et. seq., as modified from time to time, and any other applicable records keeping or age verification laws. Upon our request, you shall promptly deliver us legible copies (as may be lawfully redacted), of valid (as of the date of production of the Content) recognizable governmental photo identifications for any or all individuals appearing in any or all of your Content (demonstrating that each were at least 18 years of age on the day the Content was produced) together with the required identification forms, documents and releases. Models’ Commission Models will be entitled to receive the model program advertising share revenue (a percentage of the ad revenue that the video earns) on free to watch videos on this Websites.

You will not receive monthly a statement showing any amounts you earned. However, you will be able to view amounts earned in your account. Payments are generally made within ten (10) business days after the end of each month (although, depending on the payment method used, it may take longer for you to actually receive your payment); provided, however, that payment will be made only when the minimum payout, based on net income, of one hundred dollars (US$100.00) has been reached.
